Eat, Drink and Drive Safely

Clearing up confusion about Queensland road rules

What’s Legal in Queensland?

Despite viral claims, no changes have been made to Queensland’s road rules regarding eating, drinking, vaping, or smoking while driving.

According to Queensland Transport and Main Roads (TMR), these actions are legal as long as you maintain proper control of your vehicle.

  • Eating and drinking non-alcoholic beverages while driving is legal.
  • Smoking or vaping is permitted unless:
    • There’s a person under 16 in the vehicle.
    • You’re in a business vehicle with two or more people.

If your driving becomes dangerous or reckless, you can be charged under Section 328A of the Criminal Code Act 1899 (QLD).

What’s Behind the Fake News?

These viral posts are often created using AI tools to provoke outrage and drive clicks. The goal? Data collection, ad revenue, or social disruption.

Fake Headline Example:
“The $1,500 Sip: Australia’s New War on Common Sense”

Common red flags include:

  • Evocative headlines
  • AI-generated images with errors (e.g., mismatched police cars)
  • Buzzwords like “freedom,” “surveillance,” and “criminals”
  • Emotional language and divisive quotes

How to Spot Fake News

Tips to verify online claims:
  • Check the source: Is it a reputable news outlet or government page?
  • Analyse the content: Look for spelling errors and emotional language.
  • Cross-check: Are other trusted sources reporting the same story?
