A headline about a new driving fine can spread quickly. Before changing your understanding of Queensland's road rules, check what the official rule says and who it applies to.
This article originally responded to online claims about eating, drinking, smoking and vaping behind the wheel. The useful distinction is between an activity being specifically prohibited and a distraction that affects your driving. In our practical driving lessons for Queensland learners, keeping control and paying attention remain the starting point.
Food, non-alcoholic drinks and vehicle control
Queensland's road rules require you to maintain proper control of your vehicle and a clear view of surrounding traffic. Reaching for a snack, opening packaging or spilling a hot drink can interfere with both. A claim that eating or drinking is generally allowed should never be taken as permission to drive while distracted.
The relevant requirement is section 297 of the Queensland Road Rules. Alcohol is a separate matter: section 300A prohibits a driver from drinking liquor while driving, and also prohibits a learner's supervisor from drinking liquor while supervising.
Smoking and vaping have specific restrictions
Queensland Health's vehicle smoking rules apply to smoking products, including vapes. Smoking or vaping is prohibited in a motor vehicle when:
- A person under 16 is in the vehicle.
- The vehicle is being used for business and another person is present.
These restrictions are separate from your responsibility to control the vehicle. Being outside those two situations does not make distraction safe.
Check a road-rule story before sharing it
- Find the original source. Look for the Queensland Government, Transport and Main Roads or Queensland Police page behind the claim. A screenshot of a headline is not the rule itself.
- Check the place and date. A rule from another state, an old penalty or a proposal may be presented as a current Queensland change.
- Read the conditions. Headlines can omit who the rule applies to and the circumstances that make an activity an offence. Follow the official link before drawing a conclusion.
